Za dobro počutje gostov, zagotavljanje prijetnega bivanja in skladnosti z zakonodajo Počitniški dom Portorož (v nadaljevanju: PDP) objavlja naslednje splošne pogoje bivanja, ki veljajo za vse goste.
1. PRIJAVA IN ODJAVA GOSTOV
- Prijava na recepciji: Gostje svoj prihod prijavijo na recepciji s predložitvijo osebnega dokumenta in potrdila o plačilu rezervacije ali darilnega bona. Na podlagi prijave prejmejo ključ rezervirane sobe. Prijava je obvezna skladno z Zakonom o prijavi prebivališča (ZPPreb-1) in Zakonom o gostinstvu (ZGos).
- Spletna prijava: Pri rezervaciji preko spletne strani PDP gostje vnesejo osebne podatke (ime, priimek, naslov, e-poštni naslov, telefonska številka, podatki o plačilu). Ti podatki se obdelujejo skladno z GDPR (glej: Osebni podatki). Kupoprodajna pogodba (rezervacija) je shranjena v e-obliki na strežniku PDP in poslana gostu po e-pošti.
- Prijava preko terminala za samoprijavo: Gostje lahko prihod prijavijo na terminalu za samoprijavo, kjer vnesejo ali skenirajo podatke iz osebnega dokumenta. Terminal zbira le nujne podatke (ime, priimek, datum rojstva, EMŠO, vrsta in številka dokumenta) za izpolnitev zakonskih obveznosti. Obvestilo o obdelavi podatkov je prikazano na zaslonu terminala, polna politika zasebnosti pa je dostopna preko QR kode.
- Čas bivanja: Soba je na voljo od 14:00 na dan prihoda in jo je treba izprazniti do 10:00 na dan odhoda. Po dogovoru z recepcijo sta možna zgodnji prihod (early check-in) ali pozni odhod (late check-out), če je to izvedljivo.
- Neprijavljeni gostje: Vstop in prenočevanje oseb, ki niso prijavljene, nista dovoljena. V primeru kršitve PDP zaračuna kazen v višini 50,00 EUR na osebo, neprijavljena oseba pa plača nočitev po veljavnem ceniku in turistično takso. PDP si pridržuje pravico, da takšno osebo ali gosta, ki je omogočil neprijavljeno prenočevanje, nemudoma odstrani iz objekta. Gost, ki se ne prijavi, prevzema in v celoti nosi tudi vse stroške in morebitne izrečene kazni, ki jih zaradi neprijave izrečejo pristojni organi PDP (npr. policija, občinsko redarstvo).
2. DNEVNI RED IN PRAVILA BIVANJA
- Zajtrk: Zajtrk je vključen v ceno prenočitve in se gostom postreže med 7:00 in 10:00 ali po dogovoru z recepcijo. Iznos hrane ni dovoljen.
- Dodatna ponudba in storitve: Med 10:00 in 22:00 so gostom v dodatni ponudbi na voljo tople in hladne pijače, koktajli, prigrizki, pecivo in sladice. Cenik dodatnih storitev si lahko preberete v ločenem dokumentu »Cenik dodatnih storitev«.
- Prepoved lastne hrane in pijače: Prinašanje lastne hrane in pijače v sobe gostom PDP, ni dovoljeno.
- Požarna varnost: Uporaba grelnih in kuhalnih aparatov v sobah je prepovedana. V primeru požara upoštevajte načrt evakuacije in obvestite recepcijo.
- Čiščenje sob: Dnevno čiščenje sob in menjava brisač se izvajata po želji gosta, ki to izrazi z obešanko na vratih („Želim pospravljanje“ ali „Ne moti“) ali obvesti recepcijo.
- Hišni ljubljenčki: Hišni ljubljenčki so dovoljeni le v apartmajih. V primeru kršitve se zaračuna generalno čiščenje onesnaženega prostora oziroma območja v višini 150,00 EUR. Bivanje s hišnim ljubljenčkom je možno le ob naročilu dodatne storitve »Hišni ljubljenčki«, po veljavnem ceniku.
- Kajenje: Kajenje je prepovedano v celotnem objektu PDP. V primeru kršitve se zaračuna generalno čiščenje prostora onesnaženega s tobačnim dimom, v višini 150,00 EUR, gost pa odgovarja za škodo in kršitve po Zakonu o omejevanju uporabe tobačnih in povezanih izdelkov.
- Nočni mir: Med 22:00 in 6:00 je obvezen nočni mir in tišina. V tem času recepcija ni na voljo, morebitne kršitve ali nujne primere javite na kontaktno številko, navedeno na recepciji (+386 (0) 64 298 444.).
- Kršitve hišnega reda: V primeru kršitev si PDP pridržuje pravico do prepovedi vstopa, odstranitve gosta iz objekta in povračila povzročene škode.
3. PARKIRANJE
- Parkiranje je za goste PDP brezplačno na dvorišču PDP do zasedbe mest. Gost prejme daljinec za zapornico in odškodninsko odgovarja za njegovo izgubo (obračun po ceniku dobavitelja) ali zlorabo.
- Parkiranje je izrecno na lastno odgovornost, PDP ne odgovarja za vlome ali poškodbe vozil.
4. NAČIN PLAČILA
PDP omogoča naslednje načine plačila:

V skladu z GDPR zbrane podatke obdeluje ponudnik plačilnih storitev in PDP, ki upoštevaje Zakon o varstvu potrošnikov (ZVPot) in Direktivo EU 2015/2366 PSD2 gosta vnaprej oziroma pred potrditvijo rezervacije, obvesti o dodatnih stroških morebitnih provizij za plačilo ter jim omogoča morebiten odstop. 5. TURISTIČNA TAKSA
Turistična in promocijska taksa se zaračunata gost ob prihodu ali odhodu na recepciji ali skupaj ob enem od izbranih plačil, po veljavni tarifi Občine Piran:

6. PRIJAVNINA
Gostom, se ob rezervaciji sobe zaračuna enkratni znesek prijavnine, v višini 2 EUR na osebo. Gosti, mlajši od 7 let, so prijavnine oproščeni. V znesek so vključeni stroški prijavnine, uporabe elektronske opreme (samoprijavni terminal, elektronske ključavnice ipd.) ter digitalnih orodij (digitalna aplikacija s cenikom in možnostjo naročanja iz lokala)
7. ODJAVA REZERVACIJE/PREKINITVE IN VRAČILA
- Politika odpovedi:
- v primeru odjave rezervacije, po standardnem ceniku, manj kot 5 dni pred prihodom se gostom zaračuna 100 % znesek rezervacije.
- Cenik brez vračila denarja (non-refundable rate), gost plača 100% znesek rezervacije, ne glede na obdobje odpovedi.
- Tedenski cenik (weekly rate), gost plača 100 % znesek rezervacije, če odpove manj kot 14 dni pred prihodom.
- Pozna rezervacija (Last minute rate), gost plača 100% znesek rezervacije, če odpove manj kot 1 dan pred prihodom.
- Predčasni odhod: V primeru predčasnega odhoda iz razlogov na strani gosta PDP zadrži celotno plačilo.
- Višja sila: V primeru izrednih okoliščin ( naravne nesreče, vladni ukrepi), ki preprečijo bivanje, PDP vrne plačilo ali ponudi preložitev rezervacije, skladno z veljavno zakonodajo.
- Neskladnost storitve: Če PDP ne zagotovi dogovorjene storitve ( soba ni na voljo ali bistveno odstopa od opisa), gost lahko zahteva vračilo ali sorazmerno znižanje cene skladno z ZVPot.
- Napake pri plačilu: V primeru dvojnega zaračunavanja ali drugih tehničnih napak PDP vrne preplačilo takoj po ugotovitvi.
- Postopek vračila: Gost poda pisno zahtevo za vračilo na e-naslov ali recepcijo PDP. Vračilo se izvede v 14 dneh od odobritve na TRR račun gosta.
- Zavarovanje odpovedi: Gost lahko sam sklene zavarovanje za odpoved, ki ni vključeno v ceno rezervacije.
- Pravica do 14-dnevnega odstopa: Skladno s členom 43.m ZVPot pravica do 14-dnevnega odstopa od pogodbe ne velja za rezervacije nastanitev z določenim datumom. Za darilne bone brez določenega datuma velja 14-dnevni odstop, o čemer je gost obveščen pred nakupom.
8. OSEBNI PODATKI
PDP varuje osebne podatke gostov skladno z Uredbo (EU) 2016/679 (GDPR) in Zakonom o varstvu osebnih podatkov (ZVOP-2). Podrobnosti so navedene v Varstvu osebnih podatkov, dostopnem na spletni strani https://pocitniskidomportoroz.com/wp-content/uploads/2022/12/Varovanje-osebnih-podatkov.pdf.

- Namen in pravna podlaga:
- obdelava rezervacij in prijav gostov: pogodba (člen 6(1)(b) GDPR) in zakonska obveznost (ZPPreb-1, ZGos, člen 6(1)(c) GDPR);
- plačila: pogodba in zakonska obveznost (davčni predpisi);
- trženje (npr. obveščanje o ponudbi): privolitev (člen 6(1)(a) GDPR), ki jo gost poda prostovoljno in jo lahko kadarkoli prekliče;
- statistična obdelava in segmentacija: zakoniti interes PDP (člen 6(1)(f) GDPR), razen če gost ugovarja.
- Prejemniki podatkov: Ponudniki plačilnih storitev (npr. Worldline), računovodski servis, AJPES (prijava gostov), zunanji ponudniki IT storitev z ustreznimi pogodbami o obdelavi podatkov (člen 28 GDPR).
- Obdobje hrambe:

- podatki o rezervacijah: 5 let (davčni predpisi).
- podatki o prijavah gostov: 1 leto (ZPPreb-1).
- podatki za trženje: do preklica privolitve.

- Privolitev za obdelavo in trženje: V skladu z Zakonom o varstvu osebnih podatkov (ZVOP-2) in Splošno uredbo o varstvu podatkov (GDPR) gost s potrditvijo rezervacije ne daje samodejnega soglasja za obdelavo osebnih podatkov v namene neposrednega trženja, statistične obdelave, raziskav trga, segmentiranja kupcev ali obveščanja o ponudbi.
Privolitev za obdelavo osebnih podatkov v zgoraj navedene namene je prostovoljna, specifična, informirana in nedvoumna ter mora biti podana z izrecnim pisnim soglasjem gosta. Soglasje se pridobi ločeno od drugih pogojev, in sicer z označitvijo ustreznega potrditvenega polja na spletnem obrazcu ali z drugim jasnim potrditvenim dejanjem.
Gost lahko kadar koli prekliče podano privolitev za obdelavo osebnih podatkov. Preklic je mogoč osebno na recepciji, pisno na naslov upravljavca osebnih podatkov ali prek elektronske pošte, navedene v kontaktnih podatkih upravljavca. Preklic privolitve ne vpliva na zakonitost obdelave, izvedene na podlagi privolitve pred njenim preklicem.
Vsi osebni podatki se obdelujejo v skladu z veljavnimi predpisi o varstvu osebnih podatkov, upravljavec pa zagotavlja ustrezne tehnične in organizacijske ukrepe za njihovo zaščito.
- Varnost podatkov: PDP kot upravljavec osebnih podatkov (v nadaljevanju: upravljavec) pri obdelavi osebnih podatkov v okviru spletnih rezervacij in plačil uporablja šifrirane povezave z uporabo protokola SSL (Secure Sockets Layer), ki zagotavljajo visoko raven varnosti prenosa podatkov. Terminali za samoprijavo so opremljeni z ustreznimi tehničnimi in organizacijskimi ukrepi za zaščito osebnih podatkov pred nepooblaščenim dostopom, izgubo ali zlorabo. Prenos podatkov poteka izključno prek varnih kanalov, skladno z zahtevami ZVOP-2 in Splošne uredbe o varstvu podatkov (GDPR).
V primeru kršitve varnosti osebnih podatkov upravljavec nemudoma izvede vse potrebne ukrepe za omejitev posledic kršitve in o tem brez nepotrebnega odlašanja, najpozneje v 72 urah po seznanitvi s kršitvijo, obvesti Informacijskega pooblaščenca, skladno s 33. členom GDPR in 35. členom ZVOP-2. Če kršitev varnosti osebnih podatkov verjetno povzroči veliko tveganje za pravice in svoboščine posameznikov, upravljavec brez nepotrebnega odlašanja obvesti prizadete posameznike, skladno s 34. členom GDPR in 35. členom ZVOP-2, ter jim posreduje vse potrebne informacije o naravi kršitve, možnih posledicah in ukrepih za njihovo ublažitev.
Upravljavec zagotavlja, da so vsi postopki obdelave osebnih podatkov skladni z veljavnimi predpisi o varstvu osebnih podatkov, ter izvaja ustrezne tehnične in organizacijske ukrepe za zagotavljanje njihove varnosti.
9. ZDRAVSTVENI IN VARNOSTNI PREDPISI
V skladu z veljavnimi predpisi, vključno z Zakonom o nalezljivih boleznih (Uradni list RS, št. 33/06 in spremembe), ZVOP-2, GDPR ter aktualnimi zdravstvenimi ukrepi Nacionalnega inštituta za javno zdravje (NIJZ) ali Svetovne zdravstvene organizacije (WHO), so gostje dolžni upoštevati naslednje obveznosti:
- Upoštevanje zdravstvenih predpisov: Gostje morajo spoštovati veljavne zdravstvene ukrepe, ki jih določajo NIJZ, WHO ali drugi pristojni organi, in na zahtevo predložiti ustrezna dokazila ( potrdilo o cepljenju, testiranju ali drugo dokazilo, določeno z zakonom ali podzakonskim aktom). Neupoštevanje teh ukrepov lahko, skladno z Zakonom o gostinstvu (Uradni list RS, št. 88/10 in spremembe), predstavlja razlog za zavrnitev storitve ali prekinitev bivanja, pri čemer upravljavec ravna sorazmerno in v skladu z načelom nediskriminacije.
- Predložitev zdravniškega potrdila: V primeru zdravstvenih omejitev, ki lahko vplivajo na varno uporabo sob ali skupnih prostorov ( nalezljive bolezni), mora gost na zahtevo upravljavca predložiti zdravniško potrdilo, ki potrjuje, da zdravstveno stanje gosta ne ogroža zdravja drugih gostov ali zaposlenih. Zahteva po predložitvi potrdila je omejena na primere, ki jih utemeljujejo veljavni predpisi ali nujni razlogi varovanja javnega zdravja.
Osebni podatki, vključno z zdravstvenimi podatki, se obdelujejo izključno za namene izpolnjevanja zakonskih obveznosti (člen 6(1)(c) GDPR) ali varovanja javnega zdravja (člen 9(2)(i) GDPR). Upravljavec zagotavlja, da je obdelava omejena na nujni obseg, podatki pa so zaščiteni z ustreznimi tehničnimi in organizacijskimi ukrepi, vključno s šifriranimi povezavami in omejenim dostopom. Podatki se hranijo le toliko časa, kolikor je potrebno za dosego namena obdelave, nato se izbrišejo ali anonimizirajo, skladno s 5. členom GDPR.
- Pravice gostov: gostje imajo pravico do seznanitve z obdelavo svojih osebnih podatkov, pravico do dostopa, popravka, izbrisa, omejitve obdelave, ugovora in pritožbe. Za uveljavljanje pravic ali dodatne informacije lahko gostje kontaktirajo upravljavca osebnih podatkov prek navedenih kontaktnih podatkov. Upravljavec si pridržuje pravico do posodobitve tega obvestila v skladu s spremembami zakonodaje ali zdravstvenih ukrepov. Gostje bodo o morebitnih spremembah obveščeni z objavo na spletni strani.
10. ODGOVORNOST ZA OSEBNE PREDMETE
- PDP ne odgovarja za odtujene osebne predmete ali denar gostov. Gostom priporočamo uporabo sefa v sobi ali na recepciji za shranjevanje vrednih predmetov.
- Hramba prtljage je na voljo ob zgodnjem prihodu ali poznem odhodu. Gostom svetujemo, da vrednih predmetov (nakit, denar, dokumenti) ne puščajo v prtljagi.
11. SKLEPNA DOLOČILA
- S potrditvijo rezervacije gost potrjuje, da je seznanjen s splošnimi pogoji PDP in jih sprejema. V nasprotnem primeru lahko od rezervacije odstopi pred začetkom bivanja.
- PDP si pridržuje pravico do sprememb splošnih pogojev, ki so objavljene na spletni strani. Za dodatne informacije kontaktirajte recepcijo ali obiščite našo spletno stran
- Ponudba PDP se zaradi povpraševanja spreminja ter ažurira. V primeru, da se cena tekom obdelave rezervacije spremeni, bo gost o tem obveščen. Ponudnik bo po svojih najboljših močeh skušal v vsakem primeru gostu zagotoviti nižjo ceno oz. ponuditi ustrezno rešitev, ki bo šla v obojestransko zadovoljstvo
- Morebitne spore bodo pogodbene stranke reševale sporazumno. V primeru, da to ne bo mogoče, je za reševanje pristojno Okrajno sodišče v Ljubljani.

EKIPA POČITNIŠKEGA DOMA PORTOROŽ
For the well-being of guests, ensuring a pleasant stay and compliance with the law, the Portorož Holiday Home (hereinafter: PDP) publishes the following general terms and conditions of accommodation, which apply to all guests.
1.CHECK-IN AND CHECK-OUT OF GUESTS
- Check-in at the reception: Guests register their arrival at the reception by presenting an identity document and a receipt for payment of the reservation or a gift voucher. Based on the registration, they receive the key to the reserved room. Registration is mandatory in accordance with the Residence Registration Act (ZPPreb-1) and the Hospitality Act (ZGos).
- Online registration: When booking via the PDP website, guests enter personal data (name, surname, address, email address, telephone number, payment information). This data is processed in accordance with the GDPR (check: Personal data). The purchase contract (reservation) is stored in electronic form on the PDP server and sent to the guest by e-mail.
- Check-in via self-check-in terminal: Guests can check in at the self-check-in terminal, where they enter or scan their personal document data. The terminal collects only necessary data (name, surname, date of birth, social security number, document type and number) to fulfill legal obligations. The data processing notice is displayed on the terminal screen, and the full privacy policy is accessible via QR code.
- Time of stay: The room is available from 14:00 on the day of arrival and must be vacated by 10:00 on the day of departure. Early check-in or late check-out are possible by arrangement with the reception, if feasible.
- Unregistered guests: Entry and overnight stay of persons who are not registered are not permitted. In case of violation, PDP charges a fine of EUR 50.00 per person, and the unregistered person pays the overnight stay according to the valid price list and the tourist tax. PDP reserves the right to immediately remove such a person or guest who has enabled unregistered overnight stay from the facility. A guest who does not register assumes and fully bears all costs and any fines imposed by the competent PDP authorities due to non-registration (e.g. police, municipal security).
2. AGENDA AND RULES OF ACCOMMODATION
- Breakfast: Breakfast is included in the price of the overnight stay and is served to guests between 7:00 and 10:00 or by arrangement with the reception. Food taken out is not permitted.
- Additional offer and services: Between 10:00 and 22:00, hot and cold drinks, cocktails, snacks, pastries and desserts are available to guests as an additional offer. You can read the price list of additional services in the separate document “Price list of additional services”.
- Prohibition of own food and drinks: Bringing your own food and drinks into the rooms of PDP guests is not permitted.
- Fire safety: The use of heating and cooking appliances in the rooms is prohibited. In the event of a fire, please follow the evacuation plan and inform the reception.
- Room cleaning: Daily room cleaning and towel change are carried out at the request of the guest, who expresses this with a hanger on the door (“I want to clean” or “Do not disturb”) or informs the reception.
- Pets: Pets are only allowed in apartments. In case of violation, a general cleaning of the contaminated room or area will be charged in the amount of EUR 150.00. Staying with a pet is only possible if you order the additional service “Pets”, according to the valid price list.
- Smoking: Smoking is prohibited in the entire PDP facility. In case of violation, a general cleaning of the area polluted with tobacco smoke will be charged in the amount of EUR 150.00, and the guest is liable for damage and violations according to the Act on Restricting the Use of Tobacco and Related Products.
- Night peace: Night peace and quiet are mandatory between 22:00 and 6:00. During this time, the reception is not available, please report any violations or emergencies to the contact number listed at the reception (+386 (0) 64 298 444.).
- Violations of the house rules: In case of violations, PDP reserves the right to prohibit entry, remove the guest from the facility and compensate for the damage caused.
3. PARKING
- Parking is free for PDP guests in the PDP yard until the spaces are occupied. The guest receives a remote control for the gate and is liable for damages for its loss (calculated according to the supplier’s price list) or misuse.
- Parking is expressly at your own risk, PDP is not responsible for burglaries or damage to vehicles.

5. CITY TAX

6. REGISTRATION FEE
Guests are charged a one-time registration fee of EUR 2 per person when booking a room. Guests under 7 years of age are exempt from the registration fee. The amount includes the costs of the registration fee, the use of electronic equipment (self-check-in terminal, electronic locks, etc.) and digital tools (digital application with price list and the possibility of ordering from the restaurant)
7. RESERVATION CANCELLATION/TERMINATION AND REFUNDS
- Cancellation policy:
- in the event of cancellation of a reservation, according to the standard price list, less than 5 days before arrival, guests will be charged 100% of the reservation amount.
- Non-refundable rate, the guest pays 100% of the reservation amount, regardless of the cancellation period.
- Weekly rate, the guest pays 100% of the reservation amount if canceled less than 14 days before arrival.
- Last minute booking(Last minute rate), the guest pays 100% of the reservation amount if cancelled less than 1 day before arrival.
- Early departure: In the event of early departure for reasons on the part of the guest, PDP will retain the entire payment.
- Force majeure: In the event of extraordinary circumstances (e.g. natural disasters, government measures) that prevent the stay, PDP will refund the payment or offer to postpone the reservation, in accordance with applicable legislation.
- Non-conformity of service: If PDP does not provide the agreed service (e.g. the room is not available or significantly deviates from the description), the guest may request a refund or a proportional price reduction in accordance with the ZVPot.
- Payment errors: In the event of double billing or other technical errors, PDP will refund the overpayment immediately upon discovery.
- Refund procedure: The guest submits a written request for a refund to the PDP email address or reception. The refund will be made within 14 days of approval to the guest’s bank account.
- Cancellation insurance: The guest can take out cancellation insurance himself, which is not included in the reservation price.
- Right to 14 days of withdrawal: In accordance with Article 43.m of the ZVPot, the right to 14 days of withdrawal from the contract does not apply to accommodation reservations with a specific date. Gift vouchers without a specific date are subject to a 14-day withdrawal period, which the guest is informed about before purchase.
8. PERSONAL DATA
PDP protects the personal data of guests in accordance with Regulation (EU) 2016/679 (GDPR) and the Personal Data Protection Act (ZVOP-2). - processing of reservations and guest registrations: contract (Article 6(1)(b) GDPR) and legal obligation (ZPPreb-1, ZGos, Article 6(1)(c) GDPR);
- payments: contract and legal obligation (tax regulations);
- marketing (e.g. informing about the offer): consent (Article 6(1)(a) GDPR), which the guest gives voluntarily and can withdraw at any time;
- statistical processing and segmentation: legitimate interest of the PDP (Article 6(1)(f) GDPR), unless the guest objects.
- Data recipients: Payment service providers (e.g. Worldline), accounting service, AJPES (guest registration), external IT service providers with appropriate data processing contracts (Article 28 GDPR).

- Consent for processing and marketing: In accordance with the Personal Data Protection Act (ZVOP-2) and the General Data Protection Regulation (GDPR), by confirming a reservation, the guest does not automatically give consent to the processing of personal data for the purposes of direct marketing, statistical processing, market research, customer segmentation or information about the offer.
Consent to the processing of personal data for the above purposes is voluntary, specific, informed and unambiguous and must be given with the express written consent of the guest. Consent is obtained separately from other conditions, namely by checking the appropriate checkbox on the online form or by another clear confirmation action.
The guest may revoke the given consent for the processing of personal data at any time. Revocation is possible in person at the reception, in writing to the address of the personal data controller or via e-mail specified in the contact details of the controller. The withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of consent before its withdrawal.
All personal data are processed in accordance with applicable personal data protection regulations, and the controller ensures appropriate technical and organizational measures for their protection.
- Data security: PDP as a personal data controller (hereinafter: the controller) uses encrypted connections using the SSL (Secure Sockets Layer) protocol when processing personal data within the framework of online reservations and payments, which ensure a high level of data transmission security. Self-check-in terminals are equipped with appropriate technical and organizational measures to protect personal data against unauthorized access, loss or misuse. Data transmission takes place exclusively via secure channels, in accordance with the requirements of ZVOP-2 and the General Data Protection Regulation (GDPR).
In the event of a personal data breach, the controller shall immediately take all necessary measures to limit the consequences of the breach and, without undue delay, no later than 72 hours after becoming aware of the breach, notify the Information Commissioner, in accordance with Article 33 of the GDPR and Article 35 of the ZVOP-2. If the personal data breach is likely to result in a high risk to the rights and freedoms of individuals, the controller shall, without undue delay, notify the affected individuals, in accordance with Article 34 of the GDPR and Article 35 of the ZVOP-2, and provide them with all necessary information about the nature of the breach, the possible consequences and the measures to mitigate them.
The controller shall ensure that all personal data processing operations comply with applicable personal data protection regulations and shall implement appropriate technical and organizational measures to ensure their security.
9. HEALTH AND SAFETY REGULATIONS
In accordance with applicable regulations, including the Infectious Diseases Act (Official Gazette of the Republic of Slovenia, No. 33/06 and amendments), ZVOP-2, GDPR and current health measures of the National Institute of Public Health (NIJZ) or the World Health Organization (WHO), guests are obliged to comply with the following obligations:
- Compliance with health regulations: Guests must comply with applicable health measures set by the NIJZ, WHO or other competent authorities and, upon request, provide appropriate evidence (e.g. a vaccination certificate, test certificate or other evidence specified by law or implementing regulation). Failure to comply with these measures may, in accordance with the Hospitality Act (Official Gazette of the Republic of Slovenia, No. 88/10 and amendments), constitute grounds for refusal of service or termination of stay, whereby the operator shall act proportionately and in accordance with the principle of non-discrimination.
- Submission of a medical certificate: In the event of health restrictions that may affect the safe use of rooms or common areas (e.g. infectious diseases), the guest must, at the request of the controller, submit a medical certificate confirming that the guest’s health condition does not pose a threat to the health of other guests or employees. The request to submit a certificate is limited to cases justified by applicable regulations or imperative grounds for protecting public health.
Personal data, including health data, are processed exclusively for the purposes of fulfilling legal obligations (Article 6(1)(c) GDPR) or protecting public health (Article 9(2)(i) GDPR). The controller ensures that the processing is limited to the necessary scope and that the data are protected by appropriate technical and organizational measures, including encrypted connections and restricted access. The data are stored only for the time necessary to achieve the purpose of the processing, after which they are deleted or anonymized, in accordance with Article 5 GDPR.
- Guest rights: Guests have the right to be informed about the processing of their personal data, the right to access, rectify, delete, restrict processing, object and complain. To exercise their rights or for additional information, guests can contact the personal data controller using the contact details provided. The controller reserves the right to update this notice in accordance with changes in legislation or health measures. Guests will be informed of any changes by publication on the website.
10. RESPONSIBILITY FOR PERSONAL BELONGINGS
- PDP is not responsible for stolen personal belongings or guests’ money. We recommend that guests use the safe in the room or at the reception to store valuables.
- Luggage storage is available for early arrivals or late departures. Guests are advised not to leave valuables (jewelry, money, documents) in their luggage.
11. FINAL PROVISIONS
- By confirming the reservation, the guest confirms that he/she is familiar with the general terms and conditions of PDP and accepts them. Otherwise, he/she may cancel the reservation before the start of the stay.

- The PDP offer is subject to change and update due to demand. In the event that the price changes during the processing of the reservation, the guest will be informed. The provider will try its best to provide the guest with a lower price or offer an appropriate solution that will be to the mutual satisfaction of both parties.
- Any disputes will be resolved by mutual agreement between the contracting parties. If this is not possible, the District Court in Ljubljana is competent for the resolution.
